In a webinar on the EU Deforestation Regulation (EUDR), the experts from Taylor Wessing and Tacto gave a comprehensive overview of the regulation's requirements and its impact on companies. The topic drew strong interest, as many companies are affected by the strict obligations, which require transparency in supply chains.
What is the EUDR?
The EU Deforestation Regulation (EUDR) aims to combat global deforestation and forest degradation by excluding products linked to the destruction of forests from the European market. The regulation enters into full force on December 30, 2024 and requires companies to apply strict due diligence to ensure that their supply chains are "deforestation-free."
Objective of the EUDR: protecting forests and reducing CO₂ emissions by curbing deforestation. All relevant products linked to deforestation must be demonstrably produced in a sustainable way.
Which products are affected?
The relevant products include:
- Wood
- Soy
- Palm oil
- Beef
- Rubber
- Cocoa
- Coffee
Affected products must be checked against their customs tariff numbers (CN codes) to determine whether they fall under the EUDR. This applies to products manufactured within the EU as well as to imports and exports involving third countries.
Due diligence obligations
Companies must provide detailed information about their supply chains to ensure that no products placed on the market have contributed to deforestation. The key obligations include:
- Supply chain transparency: collecting geolocation data on the plots of land where the raw materials were produced.
- Risk analysis: companies must ensure that there is only a negligible risk that their products have contributed to deforestation.
- Risk mitigation: if a higher risk is identified, additional measures must be taken to reduce it.
Companies must submit a due diligence statement for each product, which can also be reviewed by the authorities. Without this statement, products may not be placed on the EU market.
Differences between operators and traders
The EUDR distinguishes between:
- Operators: they place products on the market for the first time (e.g., importers or manufacturers) and must fulfill the full due diligence obligations.
- Traders: they resell products that are already on the market and only need to verify the due diligence statement.
How can companies implement the EUDR?
Implementing the EUDR is a complex task, especially for the industrial mid-market. Companies must collect, analyze, and document both internal and external data. Digital solutions such as the one from Tacto provide support in meeting the EUDR requirements.
Tacto provides a platform on which companies can:
- Capture and manage product and supplier data.
- Run automated requests to collect information from suppliers.
- Create and document due diligence statements.
- Map risk management and compliance in one central system.
Conclusion
The EUDR presents companies with major challenges, as they must provide extensive information about their supply chains. Operators that place products on the market for the first time are particularly affected. Digital solutions are essential to manage the complexity of the new requirements and to ensure that all relevant products comply with the new EU rules.
Companies should start analyzing their supply chains early to meet the EUDR requirements and avoid penalties. Tacto offers tailored solutions and helps companies build future-proof, transparent, and sustainable supply chains.
