The BAFA Guidelines on the Supply Chain Act at a Glance

The German Supply Chain Due Diligence Act (LkSG) has been in effect since January 1, 2023. Initially, there were many open questions regarding the practical implementation of its requirements. Now, BAFA (the German Federal Office for Economic Affairs and Export Control) is increasingly providing concrete specifications and guidance in the form of official handouts. Published so far are guidelines on risk analysis, grievance mechanisms, and the principles of proportionality and effectiveness. These are designed to help companies translate the abstract legal text into clear implementation measures through practical guidance.
Proportionality & Effectiveness
The principle of proportionality sets the overarching framework for implementing the due diligence obligations established by the LkSG. Companies are required to introduce, monitor, and continuously develop proportionate and effective processes for fulfilling their due diligence obligations. The principle of effectiveness, on the other hand, serves the fundamental objective of the law: to improve individual human rights protection, the international human rights situation, and environmental protection. The principles of proportionality and effectiveness are closely linked, as only effective measures can form the basis for a proportionate selection. By reviewing effectiveness and proportionality, companies can deploy their resources more strategically.
Risk Analysis
Under Section 4 of the LkSG, companies are required to establish appropriate and effective risk management to identify, prevent, minimize, or end human rights or environmental risks or violations. Companies should follow a risk-based approach — meaning they should deploy their resources in a targeted manner and address the most important and urgent issues first. Risk analysis is a fundamental building block of a company's risk management and helps organizations allocate their resources as effectively as possible.
Grievance Mechanisms
Appropriate grievance mechanisms are a core element of the due diligence obligations established under the LkSG. Under Sections 8 and 9 of the law, every company must have a grievance mechanism through which internal and external individuals can report human rights or environmental risks or violations within the company's own operations and supply chain. Companies can use an internal procedure, participate in an equivalent external procedure, or combine internal and external grievance mechanisms.
Conclusion: Practical Support for Mid-Market Companies
The BAFA guidelines provide companies — especially small and mid-sized businesses — with valuable guidance for efficiently implementing LkSG requirements. With practical specifications on proportionality, risk analysis, and grievance mechanisms, companies can better meet regulatory requirements while building more sustainable supply chains.
